Ballboy Terms of Service

Welcome to Ballboy. These Terms of Service (“Terms”) govern your use of the Ballboy mobile application (the “App”). By creating an account or otherwise using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use Ballboy. By using the App, you represent that you meet this requirement.

2. Your Account

You are responsible for:

• Providing accurate information when you sign up.
• Maintaining the confidentiality of your password.
• All activity that occurs under your account.

Notify us immediately if you suspect unauthorized access to your account. You may delete your account at any time from Profile → Delete Account.

3. The Service

Ballboy is a fantasy tennis app that lets users create or join leagues, draft players, trade, view live scores and statistics, and chat with other league members. Ballboy does not involve real-money wagering, gambling, or prize payouts. Any “scores” or “winnings” within the App are for entertainment only and have no monetary value.

4. User-Generated Content

The App allows you to post content, including chat messages and team/league names (“User Content”). You are solely responsible for your User Content.

4.1 Acceptable use

You agree not to post or transmit any User Content that:

• Is unlawful, harassing, abusive, threatening, defamatory, hateful, or discriminatory.
• Contains sexually explicit material, violence, or content that exploits or endangers minors.
• Infringes any third party’s intellectual property, privacy, or other rights.
• Contains spam, advertising, phishing links, or malware.
• Impersonates any person or misrepresents your affiliation with any person or entity.
• Promotes illegal activity or violates any applicable law.

4.2 Reporting and moderation

You can report any chat message you find objectionable using the Report option on that message, and you can block any user from your view using Block User. We review reports and may remove content, suspend, or terminate accounts that violate these Terms. We reserve the right (but have no obligation) to monitor or remove any User Content at our sole discretion.

We aim to act on reports of objectionable content within 24 hours.

4.3 License to your content

By submitting User Content, you grant Ballboy a non-exclusive, worldwide, royalty-free license to host, store, display, and distribute that content solely for the purpose of operating the App.

5. Tennis Data

Tennis match information, player statistics, and live scores displayed in the App are provided by third-party data sources. We make no representations as to the accuracy, completeness, or timeliness of this information and are not liable for errors or delays.

6. Prohibited Conduct

In addition to Section 4.1, you agree not to:

• Reverse engineer, decompile, or attempt to extract the source code of the App.
• Use the App to transmit malware or interfere with its operation.
• Use automated means (bots, scrapers) to access the App.
• Use the App in violation of any applicable law or regulation.
• Circumvent any access or security controls.

7. Intellectual Property

Ballboy and its content (excluding User Content) are owned by us or our licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

8. Termination

We may suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms. You may stop using the App at any time and delete your account from within the App.

9. Disclaimers

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BALLBOY AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

11. Apple-Specific Terms

If you obtain the App through the Apple App Store, you acknowledge:

• These Terms are between you and Ballboy, not with Apple. Apple is not responsible for the App or its content.
• Apple has no obligation to provide maintenance or support for the App.
• In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation.
• Apple is not responsible for addressing any claims relating to the App, including product liability, legal compliance, or intellectual property claims.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

12. Changes

We may update these Terms from time to time. We will post the updated Terms at this URL and revise the “Last updated” date. Continued use of the App after changes means you accept the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of New York, United States, without regard to its conflict of laws rules. Any disputes will be resolved in the state or federal courts located in New York County, New York.
